Catering and Marketing Essay

To perform successfully, a catering service must be market-oriented and should apply the marketing concept, which is derived from the assumption that a product should be capable of meeting the needs of consumers, foremost, through its quality. To fully meet the needs and wants of costumers on the one hand, and to accomplish its business goals on the other hand, a catering business needs to combine the elements of the marketing mix in order to be as successful as possible in selling its product on the market. Guest satisfaction must be ensured. I. INTRODUCTION â€Å"Marketing is not only much broader than selling; it is not a specialized activity at all. It encompasses the entire business. It is the whole business seen from the point of view of the final result, that is, from the customer’s point of view. Concern and responsibility for marketing must therefore permeate all areas of the enterprise.† – Peter Drucker Food is an indispensable part of the human needs and wants that is always present in every circumstance. It is a usual unison that people have in an event which covers a large number of people dining and feasting meaning a reason for the essence of catering services. Catering services is one of the most dynamic business groups in the food and beverage industry. By industry definition, catering is the planned service of food and beverages – in contrast to restaurants, where food and beverages are generally served on demand. The opportunity for catering services to provide planned food and beverages is far greater than it is for restaurants. While restaurants are business units that serve the general public within their operating facilities, catering services, for the most part, can be provided in any venue, public or private. Unlimited types of settings, both indoors and out, are used for catering functions. The number of people who can be served at a catering function range from one to many, many more – often totalling in the thousands. For a service organization such as catering to acquire customers, it is important that marketing strategies be deployed to improve its own ability to compete with other catering services gain a competitive advantage and thus retain a greater number of customers. Marketing is an important aspect of every catering operation. As customer demands increase for catering-related services, corresponding marketing efforts must be developed. Catering business can live and die by the strength of their marketing efforts, particularly in areas with high levels of competition. An effective marketing plan can lead to the growth of your customer base, larger catering jobs, and increased profits. As consumers grow increasingly, the role of advertising and publicity become the primary vehicles for information about food and service. Definition of Terms Marketing. It is the activity, set of institutions, and processes for creating, communicating, delivering, and exchanging oï ¬â‚¬erings that have value for customers, clients, partners, and society at large. Strategy. It is the direction and scope of an organization over the long-term: which achieves advantage for the organization through its configuration of resources within a challenging environment, to meet the needs of markets and to fulfil stakeholder expectations. Catering. The activity of providing food and beverage for events. Marketing Mix. A planned mix of the controllable elements of a product’s marketing plan commonly termed as 4Ps: product, price, place, and promotion. Product. Represents a set of tangible and intangible elements used to satisfy the needs and wants of consumers. Promotion. The publicization of a product to increase sales or public awareness Price. A value that will purchase a finite quantity of a product or service. Product Distribution. It is the process of making a product or service available for use or consumption by a consumer. Scope and Delimitation of the Study This study is conducted specifically on eleven (11) Catering Services in the locality of Bataan. Specifically the eleven (11) catering services are as follows: 1. Tony and Ann Catering Services – located in Balanga City 2. Mommy-Tah’s Catering – located in Orion 3. Petrius Resto and Bar Catering – located in Balanga City 4. Goldiluz Catering – located in Balanga City 5. Ysiad’s Catering – located in Balanga City 6. Cora’s Catering – located in Orion 7. Junifred Catering Service and Accessories- located in Orani 8. Cj’s Catering Services – located in Dinalupihan 9. Mattro Catering Services- located in Hermosa 10. Gourmet Catering and Flower Shop- located in Orani 11. Know- Well Catering Services- located in Abucay The eleven (11) Catering Services were subjected to survey questionnaire. One catering services at a time. Furthermore, this study was limited to finding only the effectiveness of the marketing strategies used by the different catering services. Statement of the Problem The main purpose of this study was to find out the effectiveness of marketing strategies used by different catering services in the locality of Bataan. Specifically, the study sought to answer the following questions. 1. Is there a significant relationship between the location of the business and its marketing strategies? 2. Is there a significant relationship between the number of years of the business and its marketing strategies? Significance of the Study A study such as this enabled the different catering services in the locale to see if their marketing strategies were effective to increase their income. Furthermore, this is also important to all the catering services for this will help them in the promotion of their services using different marketing strategies. With the use of various marketing strategies, catering services may lead to higher income. Moreover, the useful and relevant information acquired from this study may help future researchers in the same field of study. This study will further help the catering services to develop more effective marketing strategies. Related Literature According to Scanlon (2007), the marketing mix includes the marketing strategy elements and may be conducted either as an alternative to the marketing cycle or as a continuing activity in the market process. The marketing mix incorporates the four basic elements into the overall strategy of marketing a product or service. The four basic elements consist of: †¢ a product (product) †¢ the price of the product (price) †¢ the promotion of the product, and (promotion) †¢ the distribution of the product. (place) The product. This is the primary element of the marketing mix, with the other elements adjusting to it depending on the given situation. The product represents a set of tangible and intangible elements used to satisfy the needs and wants of consumers. The product has all the attributes of a service, and it is designated for the market. What is a service, and which are the attributes of a product as a service? A service represents the result of the interaction of three basic elements: the user (guest), equipment (facility), and the service staff (staff). This result should meet the needs of guests (for example, wedding reception). The process of building a service brand is vital to the product as a service. Becoming distinctive in the marketplace and building a brand helps to gain the trust of guests. Product price. The pricing should be based on three key elements: †¢ service demand, †¢ costs incurred in creating services, and †¢ comparing and adjusting prices to those of rivals on the market. Some potential customers are more sensitive to prices than others. For some, price is the single variable on which they base their decision to buy (or not to buy) a product, while others care nothing for the price, as long as it guarantees the quality of services provided. Hence, businesses need to be elastic in pricing. They must carefully monitor the reactions of customers to prices and, accordingly, adjust or change prices depending upon demand. Costs clearly influence the price of a product, and they determine the bottom price below which a business will begin to loss money. Prices should not, however, be overly cost-oriented, and they should not be increased to cover costs. Instead, they should be based on demand and adjusted to changes on the market. Rivals also play an important role in pricing. A business will often be compelled to change its pricing policy as a result of changes in the prices of rivals. Considering how fierce competition is today, it must be analyzed and mon itored. This means that prices, once fixed, cannot be allowed to remain unchanged, but rather, their adjustment to change should be taken as a sign of their flexibility. Product promotion. To promote a product, the business communicates with the market of demand. The market of demand comprises potential customers, various business organisations and organisations belonging to non-economic branches, and media. In promoting a product, a variety of promotional methods are used to present the product to potential customers and attract their attention. Considering the growing number of promotional methods available today in promoting a product, businesses choose to use a combination of promotional elements.

Chinese Nationalist Party Essay

On 1 October 1949, Mao Zedong, leader of the Chinese Communist Party declared victory over the Nationalist Party (Guomindang) and brought an end to four brutally long years of Civil War. The Communist victory in the Civil War has however, created significant debate among historians, namely: was a Communist victory inevitable and if so is it more sensible to see the Chinese Civil War as a Communist victory or as a Nationalist defeat?When researching these questions it becomes blatantly obvious that the Guomindang government led by Chiang Kai-Shek was riddled with problems and they are very much the cause of their own downfall. Widespread government corruption, spiraling inflation, loss of public confidence and intractable poverty are just a few of the failings the Guomindang afflicted upon the Chinese people. These monumental failings make a Communist victory seem almost inevitable, in that they just happened to be there to assume power as the Nationalists lost support and drowned in their own mistakes. In this sense it is more sensible to view the Civil War as a Nationalist defeat, rather than a Communist victory. On the other hand, the Communists were able to turn dismal rural poverty and the Japanese invasion into assets, using them to convince villagers that radical change was imperative and that the Communist Party was best qualified to bring about this change. Seen in this light, superior strategy and organisational methods allowed the Communists to achieve victory and not just â€Å"move into a vacuum† as suggested by Barnett (Barnett, 1965: 1). There is certainly an element of inevitability with regard to the Communist victory, however, in this essay I will argue that not only was the outcome of the Chinese Civil War not preordained, but I will also critically evaluate the reasons the Guomindang lost the Civil War and explain that given their policy mistakes, the Civil War should be seen as a Nationalist defeat rather than a Communist victory. If the Nationalists had been willing to adapt and had they initiated some changes in their strategies, the Communist Party, no matter what its internal organisation or external strategies, would not have been able to bring revolution to China. This theory is not supported by Kubek, who argues that the cause of the  Nationalist defeat was due to a lack of aid from the United States, declaring â€Å"sovietisation of China and Manchuria could be the only logical outcome of post-war United States policy in China† (Kubek, 1965: 62). This view point is unduly simplistic and overvalues America’s role in China, an opinion supported by Chang, who believes the Guomindang government’s â€Å"failure was due not so much to lack of American support, but to its inherent defects† (Chang, 1965: 40). Before analysing these inherent defects and the reasons that the Nationalist Party lost the Civil War, it is important to understand the fundamentals of the situation in China at the end of World War Two; specifically the consequences of the eight year war with Japan that totally exhausted the Guomindang militarily, economically and spiritually. Hsu argues that the war with Japan is the â€Å"single most important cause for the downfall of the Nationalists† and â€Å"had there been no Japanese war, the situation in China would have been very different† (Hsu, 1990: 734). Many of the Guomindang’s problems such as factionalism, corruption and leadership were prevalent prior to the Sino-Japanese War; however it was during the last phases of the Sino-Japanese War that these problems reached crisis proportions and in hindsight it seems impossible that the Guomindang could have overcome these problems to defeat the Communists (Service, 1965: 29). Chang also believes that the Guomindang faced insurmountable problems prior to the Civil War, stating that â€Å"the government of Chiang Kai-Shek was built on quicksand and clay. How can it stand? Is it any wonder that it fell like a house of cards when it had to face the Communist crisis?† (Chang, C. 1965: 41). Westad, (2003: 7) however argues that â€Å"in spite of the Guomindang’s weaknesses, the outcome of the post-war conflict with the Communists was no way predetermined in 1945†. At the end of the Sino-Japanese War the Guomindang held significant advantages over the Communists, with its widely recognised legitimate government controlling China, giving it the power to tax and conscript. On the other hand, the Communists could not match the Guomindang’s troops in terms of training and equipment and could be  Ã¢â‚¬Å"outgunned and outmanoeuvred in all major regions of the country† (Westad, 2003: 8). Furthermore, the Communist party was hardly represented in the cities at all, which of course was the power base of the Guomindang. However, the Communists also had successes resulting from the war with Japan including increasing their area of control and practiced evolving their strategies of protracted guerrilla warfare against the Japanese which in turn generated public support. Despite this the party’s main forces were still located in North-west China and they were not in such a powerful position that a civil war with the Guomindang would be a mere formality in securing control of the country. The Civil War is therefore simply not a case of the imminent decline of the Guomindang and the Communists’ irresistible rise. Rather the Sino-Japanese War provided the framework for the decisions and strategies that would ultimately lead to Nationalist defeat. The war with Japan left the Guomindang decimated and they did need to undergo reform in order to survive; however the factionalism and corruption within the Guomindang resulted in increasingly repressive controls being implemented upon the war weary Chinese people. At a time when new strategies were needed, the government instead continued its repressive controls and when war again broke out, the government lost even more support and collapsed with cataclysmic speed. This was due in no small part to the leadership of the Guomindang, whose perpetuation of their own power dominated over all other considerations (Service, 1965: 28). The arrogance and mismanagement of the Guomindang alienated the Chinese people and caused a loss of public confidence and respect. This loss of respect not only resulted in the Nationalists losing influence in their own power bases, but made it easier for the Communists to exploit this public disharmony and encourage the Chinese people to think that a change in administration would bring about a change in their fortunes. An example of the Guomindang’s poor leadership strategies can be seen in their occupation of former Japanese colonies (Service, 1965: 29). The Chinese citizens within these Japanese occupied territories had waited eight  years for the return of Nationalist rule, but instead of being treated as victims of war, they were exploited. The Guomindang leaders did not return their land but acquired it as their own property; moreover, they virtually eliminated the monetary assets of these people. This was caused by the currency in the occupied territories going through extreme inflation as the government only offered the exorbitant exchange rate of two hundred to one; when a more reasonable rate would have been half that much (Phillips, 1996: 158). Furthermore, the puppet leaders that had been installed by the Japanese often kept their positions or became members of the Guomindang. Poor policy decisions such as this would lead to the downfall of the Guomindang, as it is impossible to fight an effective war without the support of the people and the economic policies of the government alienated millions of suffering people. The Guomindang’s economic problems were not limited to the territories formerly occupied by the Japanese. All over China inflation was an exceptionally large problem, for as the increases seen during the Japanese War were allowed to spiral out of control during the Civil War. Service, (1965: 29) argues that this is a direct result of corruption within the Guomindang, and that they refused to take any effective steps to check inflation or implement agricultural reforms for fear of losing the support of the landlord class in China. In view of this, the Guomindang developed urban industry at the expense of agricultural and financed this by simply printing more bank notes. Their economic mismanagement was disastrous for the majority of the Chinese people and meant that by 1948 government expenditure had become thirty times larger when compared to its pre-war level; the budget deficit had also blown out to thirty times it pre-war level and inflation was increasing at the rate of thirty per cent a month (Chang, K. 1965: 23). The Nationalist government faced imminent financial doom and the Chinese people were becoming aware of the selfish nature of their government whose economic policies and financial mismanagement destroyed the livelihood of hundreds of millions of Chinese. The failings of the Guomindang would provide the Communist party with ample opportunities to exploit the discontent of the Chinese people. This was one of the reasons for the Communist victory in that they were able to gain the support of people from the rural areas who the Guomindang had alienated. An example of this can be seen in the rural land reforms implemented in newly gained territories. In these areas the Communists promoted production and ensured supplies by creating a self-sufficient economy. To rouse the productive enthusiasm of the peasants, they launched a campaign to reduce rent and interest. Peasant associations and other organisations were urged to demand and enforce a 25 percent rent reduction, with a rent ceiling set at 37.5 percent of the crops. The interest rate on loans was limited to 1.5 percent a month, or 18 percent a year, much lower that the excessive rate formerly charged by the landlords (Westad, 2003: 11 and Fielding, 1999: 134). They were able to achieve these reforms without confiscating large amounts of land, as considerable redistribution of land to the peasants was accomplished by impo sing graduated taxes in such a way that larger landholders voluntarily sold land because it was no longer profitable. It is arguable that the Communists had no intention of eliminating the economic power of the landlords, but instead they showed the peasants that they could exercise their power locally and play an active role in the war against a government that some had come to despise. The Communists gave the peasants what they wanted: an army of friendly troops who not only did not steal their crops but helped them bring in the harvest and who implemented popular but gradual economic reforms (Ebrey, 1996: 289). This is in stark contrast to the Guomindang who did not understand the peasants and showed no interest in aiding them. They failed to see the revolutionary potential of the peasant masses and unlike the Communist Party never attempted to organise them. This situation was best summarised by Hsu: â€Å"the stone that one builder had rejected became the cornerstone of the other’s house† (Hsu, 1990: 738). However, many of the most important cause of the Nationalist defeat during the Civil War were military ones. Despite emerging from the Japanese War better equipped and trained, the Nationalist Army was a tired force (Hsu, 1990: 734). This war-weariness was felt throughout China and there was  widespread recognition that full scale civil war would be a tragedy for the country. It is therefore, not surprising that the Guomindang’s persistence in military aggression towards the Communists, who were Chinese after all, failed to arouse the same patriotic loyalty as when the enemies were Japanese (Stuart, 1965: 19). Given this situation the Nationalist Army needed good leadership and to gain the support of the people; they were unsuccessful on both counts. This was largely due to the leadership system created by Chiang Kai-Shek that was â€Å"a congerie of conservative political cliques† concerned primarily with maintaining their own power (Service, 1965: 30). Furthermore, the highest military posts were reserved for those who like Chiang Kai-Shek had graduated from the Whampoa military academy and this often meant that more talented officers were turned away. General Barr of the United States said of the Guomindang leadership in 1949 that, â€Å"their military debacles in my opinion can all be attributed to the world’s worst leadership and many other morale destroying factors that lead to a complete loss of will to fight† (Barr, 1949: x quoted in Bianco, 1971: 180). In fact, many battles were lost by the Nationalists without a fight, as hundreds of thousands of troops simply defected or surrendered to the Communists (Barnett, 1965: 5). An example of this may be seen during the Huai-Huai Campaign, where poor military leadership caused the Nationalist troops to become surrounded and resulted in an irreparable loss of manpower without a fight (Phillips, 1996: 158). Rather than undertaking offensives to seek out and destroy the main mobile guerrilla units of the Communists, they holed up for the most part in isolated, vulnerable, defensive positions allowing the Communists to concentrate their forces and attack and overwhelm Nationalists’ positions one by one (Barnett, 1965: 5). This strategy played into the hands of the Communists whose primary goal was to reduce the numbers of the Nationalist army. They were not concerned with holding specific geographic areas and this allowed them to be a lot more flexible in their attacks. Moreover, the Communist troops were ordered to avoid large battles and to engage the enemy only when there was a high probability of victory. Mao Zedong argued that the only way guerrilla warfare could succeed  is if the army had the support of the people, and the Communists certainly had this (Mao Zedong, 1940: x cited in Bianco, 1971: 184). The Communists successfully achieved this through the use of propaganda. They portrayed themselves as defenders of the nation and the Guomindang as enemies of all levels of society, from peasant to scholar (Chang, C. 1965: 40). Chiang Kai-shek himself admitted that the Nationalists failure in propaganda â€Å"was a major defect in our struggle against Communism† (Kai-shek, 1965: 77). Despite this, the Nationalist army had many opportunities to seriously weaken the Communists. However, their leadership too often committed crucial tactical mistakes, which were the result of lack of communication and disputes within the party caused by the factionalism that riddled the Guomindang leadership (Westad, 2003: 11). Clique politics and factionalism would eventually lead to the situation where unified action to either solve the problems in Nationalist held territory or to fight against the Communists became virtually impossible (Barnett, 1965: 6). This is in stark contrast to the leadership of the Communist armies, whose generals were not concerned with personal gain, but instead co-operated with each other and gained the support of the Chinese people and worked towards a united goal (Westad, 2003: 9). These superior military tactics and aforementioned economic reforms brought the Communists wide spread support and ultimately victory. However, this victory would never have been achievable were it not for the military, economic and social failings of the Guomindang. Chiang Kai-Shek himself admitted major defects in organisation and technique in the Nationalists’ war against Communism, however he argued that these defects were remediable, â€Å"so long as our strategy and policy were correct, I believe we still could have won† (Kai-Shek, 1965: 82). It is in this light that the Chinese Civil War should be viewed not as a Communist victory, but as a Nationalist defeat. There is no doubt that the war against Japan was a crushing blow to the Nationalists economic and military power, however it was not fatal. The  Nationalist government could have continued to consolidate its power and authority by the sheer weight of its military strength and financial resources (Tsou, 1965: 28). Even though the Nationalist government was far from popular, it was the most powerful military and economic force in China and could have survived if it had been willing to regain the support of the people. Defeat to the Communists was therefore, far from inevitable, and the Nationalists were very much the engineers of their own demise. BIBLIOGRAPHY Barnett, A. Weakness With the opening of new terminal 5 at Heathrow airport by the British airways, the company faced problems with training of staff, which led in flights being cancelled, complains of missing luggage. Moreover the rising fuel prices led to increase in ticket prices. The slowdown of both the UK and US economies has affected British Airways as the company has become very vulnerable to financial instability. The bankruptcies in the US banking sector decreased the number of premium booking passengers in British airways heavily. The route of Heathrow and New York is having huge traffic of passengers and forms an important part of British airways earning. Therefore, the drop in the bookings of premium class affected the profitability of the company. British airways also suffered from increased in non fuel costs like from staff and the landing charges. For emirates airlines, there is some weakness also associated with it, like it is not being successful in all of its diversification and approaches, which has emerged as a weakness of the company. Analysts have blamed the company for too much emphasizing on high end acquisitions and diversifications in spite of getting the type of results from such decisions. As U.S is a major market for the airline industry and emirates airline does not cater to many places in the U.S., which is also a weakness for the company. Opportunities If British airways will fully acquire the Iberia airlines with currently 13% share, then it will be in the list of the worlds biggest airlines having approximated combined stock market capitalisation worth of EUR 5.5 billion. There is an opportunity for the British airways to expand more in emerging markets like Middle East Region, India, and China. Another opportunity for British Airways is to now improve the operating conditions of its terminal 5 at Heathrow airport. The company should focus on minimum cost of travelling to fulfil customer needs. With the increase of fuel efficient aircrafts of British airways it can minimize the environmental damage, as protection of environment is emerged as an important issue throughout the world. The company should also see an interest of customers towards new places and develop new routes wherever possible. On the other hand for emirates airline the opportunity lies in which, it can use its well developed infrastructure business to go into the new emerging markets where internet adoption is not very well developed. Same as for the British airways, there is also an opportunity for emirates to introduce new routes by observing the interest of customers. As also Dubai and the middle-east region is more advancing for tourism and commercial purpose enables emirates airline to grow. Threats The current threat to British airways is from current economic slowed down, increased fuel prices and weaker pound. The global recession has severely affected air transportation. The travel and tourism industry is moving towards including more green practices. There is pressure from European Union on all the airlines companies to limit carbon emissions Across EU. The two articles â€Å"The Knight Who Thought He Was King,† and â€Å"Knight Fall† try to answer these two controversial questions. Each of these articles present the debated issue in their own distinct ways. â€Å"Knight Fall† is written in a way that the reader really doesn’t know what side the author is choosing, that is until the last few sentences. On the other hand, the other article is very distinct, and the reader knows for a fact, just from reading the first few sentences, that the author is not what you call a â€Å"Bobby Knight fan.† Both of these articles use the three rhetoric appeals to help persuade their audience.   Ã‚  Ã‚  Ã‚  Ã‚   â€Å"He also thought -indeed, no thought to the contrary seems ever to have made its way into his head- that he was larger than the university itself†¦he signed the papers placed before him and then blithely violated the very agreement he supposedly had accepted, obviously on the assumption that the policy simply did not apply to a god such as him.† (Yardley.) Well if this isn’t straightforward enough for one to understand, then the reader has problems. This is how Yardley uses intrinsic ethos. He is an author for the Washington Post, in the style section, and writing about sports. One who is reading this article is not expecting a remarkable well-informed sports article. Throughout the article he uses a sophisticated vocabulary and strong, powerful words to grasp the attention of his audience. This article doesn’t exactly give the reader much leeway in choosing a side; there is not one good thing about Bobby Knight in this article.   Ã‚  Ã‚  Ã‚  Ã‚  Throughout this editorial, the author really tries to get to your emotions. He uses pathos to try to persuade the reader into not liking Bobby Knight. â€Å"He screamed at referees, berated and belittled members of his own team, heaved chairs.†(Yardley) He is trying to make you dislike Knight, for the things that he has done in the past. He is making Knight to be this immoral individual, who tries to hurt and inflict pain on others. He also states how Knight violated policies, only because they didn’t apply to him. All of this is mentioned just to get the reader to think â€Å"yea, I’m glad he was fired, he was a confused menace to society, who should have been fi... ...be a coach today. â€Å"Knight Fall† also uses cause and consequence. It brings up the point that if Harvey (the student) didn’t come forward and complain about Knight’s abuse, then Knight probably would still be coaching. But that incident was only the tip of the iceberg. Knight had done so many things before that, and in the article, each incident is brought up, and questioned; whether if Knight had not done that, if he still would be coaching. Of course all of this means nothing; it’s all too late. It’s just the two different perspectives.   Ã‚  Ã‚  Ã‚  Ã‚  Well these two articles aren’t too hard to compare. One uses such vulgarity, that it makes such an impact on the reader, that the reader has no choice but to believe what the author is telling you. The other, a very informative and thorough article, lets the reader read, and learn, before â€Å"choosing a side.† Reading this will help you understand the situation, from both points of view, and then only to see the authors point of view in the last paragraph of the entire article. In the other article, Yardley doesn’t waste any time in stating his opinion, opening his article with disgust for Knight. These are two perfect articles to compare.

Comparing Morality  in  The Prince, Second Treatise of Government, and Utilitarianism Niccolo Machiavelli, John Locke, and John Stuart Mill present three distinct models of government in their works The Prince, Second Treatise of Government, and Utilitarianism. From an examination of these models it is possible to infer their views about human nature and its connection to the purpose of government. A key to comparing these views can be found in an examination of their ideas of morality as an intermediary between government and human nature. Whether this morality must be inferred from their writings or whether it is explicitly mentioned, it differs among the three in its definition, source, and purpose. Approximately three hundred years separate the earliest of these works, The Prince, from the most recent, Utilitarianism, and a progression is discernible in the concept of morality over this span. Machiavelli does not mention the word "morality," but his description of the trends and ideals of human political interaction allow for a reasonable deduction of the concept. Locke, too, does not use the word, but he does write of "the standard of right and wrong." In contrast, Mill writes explicitly and extensively of morality in its forms, sources, and obligations. A logical starting point in this examination is a look at their relative views of human nature. To Machiavelli, people are children that need order. They are childlike, not in their innocence, but in their passions. They are ungrateful, greedy, deceptive, and fickle. However, they are also rational and interested in avoiding danger. In calculating their interests they can perceive the need to join together to pursue common goals, such as conquest for acquisition, p... ...e driven into civil society by their contentious natures. As such, all three have the need for an organizing and directing influence in society to ensure that it accomplishes the ends for which it exists. For Machiavelli and for Locke, this influence comes directly from the government. For Mill, this influence comes from within society, the associations one forms with other people; however it requires a certain minimal support from the government to keep it on the proper track. Throughout the economic reforms of the 18th and 19th centuries life for the peasantry moved from one ill to another. The turbulent economic changes that marked this period would benefit the lifestyle of one generation only to completely impoverish the next. It wasn't until the latter part of the 19th century that the standard of living for the average citizen moved toward what could be considered comfortable. In the early part of the 1700s the majority of Europeans were living in rural communities of no larger than 1000 people. Their lives focused only on survival. They would farm small plots of a larger field, the right for which they would often have to pay a considerable amount of their income as rent to the landholder. In most cases, for warmth they would sleep under the same roof as their animals, and heating sources usually consisted of wood, peat or dung, but very rarely coal. While this lifestyle is harsh it had its benefits. Due to the fact that one field would be cultivated by a large portion of the community, decisions on the crop rotation would have to be determined as a community. This provided the peasant with some modicum of freedom. When landholders started enclosing fields, and began cultivating them for profit, it devastated millions. Suddenly they had no immediate source of food nor a place to graze their animals. The immediate effect was wide spread starvation. The long-term result was that with the efficient management of fields, and the introduction of new crops, like the potato, food became more abundant. This instituted a population boom throughout most European nations. With the introduction of the putting-out system by many merchants, as a means to circumvent guild control over the manufacture of goods, peasants were able to support themselves. With their newfound work, and the increased abundance of food they were finally able to feel secure in their livelihoods. This was just the calm before the storm. The growing desire among the bourgeoisie for financial gain paired with new technological advances made the putting-out system inefficient. Shifts in production were made toward small workshops or larger factories. Over time the demand for rural industry decreased to the point where many were accepting next to nothing for their goods. It became virtually impossible for the peasantry to make a living in rural communities. They were increasingly forced to move to cities where they could find factory work. Liverpool, for example, grew by 250 percent between 1600 and 1750. With even further advances in factory mechanization, hundreds of thousands of jobs became â€Å"obsolete†. After all, if you have a machine that can do the job of one hundred men, why pay one hundred men? Once again there was a widespread loss of jobs. Public opinion on poverty at the time did nothing to help the situation either. The poor were grouped into two categories: the deserving and the undeserving. The deserving consisted of children, the elderly and the crippled. The undeserving were healthy men and women who either were unable to find work. The attitude was that it was their fault they were poor, and thus they were treated as little better than criminals. It wasn't until the advent of the railroad that things really started looking up for the average citizen. The sheer amount of work required in the construction of a railroad alone provided many with work. In addition, it now became cheap to transport metal, and other heavy raw supplies for the manufacture of goods. This not only dropped the price of commodities, but also spurred industry to an even greater extent. I feel it evident that these economic reforms consistently threw the lives of the average citizen into upheaval. We must not overlook, however, the ultimate good this period did for the world. Were it not for the willingness of those early capitalists to take advantage of the peasantry as they did, we would all likely be farming a small plot of land and heating or homes with dung.

Essay Revision Policy: You may revise and improve the grade of Essay 1 and Essay 2. However, in order to submit a revision for a better grade, you must do the following: 1) Enroll in Eng N91 and discuss your rough draft with your Writing Center instructor before you submit the essay to me. Provide proof that you have discussed your rough draft with WC instructor. ) 2) Submit your essay on time. It is up to you to bring that grade up or down throughout the semester. Library System Essay

Technology has already become one of the essentials of a person’s daily living. Without it, life would be much more complicated for people will still always have to do things manually. It has already helped billions of people here on the planet. It simply makes life much easier. It makes tasks easier and faster to accomplish. Furthermore, technology has already been a part of our daily lives. It is everywhere; from the simplest things like mobile phones to the biggest machineries. It is already given to people and it’s up to you to maximize its use to the fullest. Technology is needed everywhere; grocery stores, malls, offices and especially in schools. Not only should the students learn how to use technology, computers to be exact. It also has to be learned by the instructors to keep up with this fast-growing computer age. In line with this, they also need it to ease their tasks from calculating grades to simple library systems. Handling a library could be a very complicated task as you need to keep an updated list of the books being used, borrowed and returned. Also, a librarian’s task is to organize these books so that it would be easier to find. Most libraries still stick to the manual system from long ago. This makes their job more complicated and more time consuming. A library system is important to a library to make the job for looking, arranging, borrowing and returning of books simpler with just a couple of clicks. Books would be much easier to find and borrowing and returning of books would be updated easily. With everything systemized and automatic, it will lessen the job of the librarian. 1. 1Background of the Study San Roque Catholic School is parochial catholic school located beside San Roque de Alabang Parish, Mendiola, Alabang, Muntinlupa City. It was established in 1981 by parish priest, Monsignor Tomas T. Gonzales. Its first batch was made up of one hundred forty one students which were divided into three sections. It was in 1982 when its three-storey building was begun to be built, due to the increase of the population of the students in the following year. Their first principal was Miss Lydia Santos. For 31 years, San Roque Catholic School has been providing affordable, high quality education to its students aiming to cultivate spirituality, evangelize and spread Christianity. In the present, San Roque Catholic School has a population of about nine hundred to one thousand two hundred students and approximately 20-25 faculty members. It already has two campuses: The main which is the original building and the annex that serves as the building for the elementary students which is in Ilaya, Alabang, Muntinlupa City. The school library is located at the 3rd floor of St. Roch building. It was built by joining two rooms together. Half of the library contains the librarian’s desk, books, and tables. The other side is where magazines, newspapers, computer units, and the latest books are. The number of books hasn’t grown that much for the past years. It has approximately 1000-1500 books. An average of 10-20 classes visits the library every day. Almost half of the class borrows books. Although they already have an existing library system, the librarian still finds it inefficient to manage the books for the students. On our system, we have our current features; Login system with History log, for security on the administrators and assistants. The system has simple processes like add, edit & archive a book to database, and Filtered book search results. Has a book preview pane, gives the librarian the image of the front page of the book. Have Corporate GUI design that is neat and user friendly. Everyday alert, gives the librarian each updates on everyday processes and transactions. Daily, Weekly & Monthly Reports and has an penalty which is very convenient. 1. 2 Statement of the Problem After gathering information, the proponents found the following problems: General Problem The school manual library system is time consuming and is sometimes inaccurate. This doubles the job at hand. The proponents also found out that the penalty of the due books is sometimes miscalculated by the manual system, which can hinder the library’s implementation of rules against overdue books. It usually takes long for the librarian to accommodate many borrowers at a time because of the system’s process. Specific Problem 1. The system cannot view the content of each book when borrowing. 2. The system process is not easy. 3. The system lacks of security. 4. The system cannot confirm the identity of the book that is being borrowed. 5. The system’s process of updating information is time-consuming. 6. The system’s catalogue process is manually maintained. 1. 3 Objectives of the Study This study was made in order to achieve the following points: 1. 3. 1 General Objectives To develop an efficient and user-friendly library system for San Roque Catholic School that will ease the process of the system. 1. 3. 2 Specific Objectives 1. To create a system that will preview the content of each book; 2. To build a system that has an easy to use-all in-one interface; 3. To make a multiple user-account system. 4. A system that will preview the cover of each book. 5. System that will be able to update the information on each book. 6. To develop a system that is cataloguing ready. 1. 4 Significance of the Study The system is being fulfilled in order to benefit the following: †¢ School Administrator The system will ease the inventory of the library system. Determining the number of available copies and the number of copies needed for each book won’t take much time. †¢ School Librarian The system will avoid long lines when students borrow books at the same time thus, it will make the job much easier and more time constraint. It won’t be a hassle tracking down penalty fees anymore. †¢ Students The system will make it easier to browse books without checking every shelf for its availability. †¢ Future Proponents The system will serve as guide for future use and also a practice for aspiring programmers. 1. 5 Scope and Limitations The scope of this study: The Study is conducted at San Roque Catholic School. Therefore, we’ve managed to produce a few scopes on the system. †¢ The User Interface We will be focusing more on making the system more user-friendly. †¢ Borrowing System. The system allows viewing of borrowers and books for the librarian. The system is able to retrieve the books borrowed date and return date. †¢ Catalogues The catalogues are printable whether it is single or multiple. †¢ Preview of Book Cover The book cover is able to be previewed using the library system without needing to search for the book in the shelves of the library. †¢ Overdue penalties The system is able to track down the number of days the book is overdue and as well as the total penalty to be paid by the borrower. The limitations of this study: The system that we’ve created has few limitations, issues like lack of time, Error Fixings and Maintenance. †¢ Weekly Reports This feature has been implemented but it is not yet accurate. †¢ Library Cards This feature cannot be implemented in our system due to technical difficulties. Methodology The researchers decided to use the prototyping paradigm. Prototype systems development methodology in which a prototype is built, tested, and then reworked as necessary until an acceptable prototype is finally achieved from which the complete system or product can now be developed. This paradigm is very helpful to the group because the system can be adjusted frequently even the small details to make the system effective to the library. System Development Life Cycle Planning Phase In this Phase, is to plan and achieve the client’s perspective on their said features, think all possible problems that may appear while building the system and how to create that system in efficient way and not time consuming. Analysis Phase Phase that focus on all errors or problems can be acquired, how to resolve it and meet all the expectations of the clients. Design Phase In this Phase, To create a system that is very easy to use, have a well organized codes, have a user friendly GUI and meets all requirements needed to impress the clients. Implementation Phase Where the system is finished, all data are converted, resolve all possible errors during on designing and until its ready to install on their computer. Its smooth and efficiency makes the system great on quick processes. Maintenance Phase This phase checks and maintains the system for unspecified or unexpected errors that have been occurred after using it. The system can also be updated, giving it a better performance on each task.

Employment Law Essay

Early this year, there are reports that the number of employees calling in sick has risen to staggering levels. According to an absence management company, there are about 3. 6 million employees who called in sick the first week of January (Pitcher, 2008). The United Kingdom ranked as second as having the most number of employees with long term sickness in a survey conducted by the European Community (Tehrani and Rainbird, 2005). The level of absence for UK was 27. 2% as against an average of 16. % of the European Union (Tehrani and Rainbird, 2005). An approximate figure of 14. 1 million days ‘were lost to stress and anxiety in 2001† (Tehrani and Rainbird, 2005). Absences due to stress and mental problems significantly affect both the employer and the employees. This matter apparently has been taken for granted and unaddressed for sometime until the enactment of the Disability Discrimination Act 1995 (DDA), Employment Act 2002, Employment Rights Act 1996, and the Health and Safety at Work etc Act 1974. This paper shall show the manner by which the pertinent provisions of these pieces of legislation are applied to a hypothetical case and it shall also seek to identify and explain the remedies of an employee in case of violation of the provisions. Disability—Sickness Absence The Disability Discrimination Act 1995 defines disability as one having a ‘physical or mental impairment which has a substantial and long-term adverse effect on his ability to carry out normal day-to-day activities’ (Section 1(1), Part 1, DDA 1995). The Industrial Tribunal has applied the definition to the different cases brought before it. For instance, in the case of Greenwood v. United Tiles Limited; the employee concerned was suffering from diabetes and was held to be disabled by the Tribunal (Greenwood v. United Tiles Limited 1101067/97/C). In the case of O’Neil v Symm & Company Limited, the Tribunal considered ME or chronic fatigue syndrome as a disability (O’Neil v Symm & Company Limited, 2700054/97). Even abdominal pains which had no medical diagnosis with respect to its origin was declared as a disability by the Tribunal in the case of Howden v Capital Copiers (Edinburgh) Limited (400005/97) (Thompsons Solicitors web site, 2007). Anent mental disability, Walton v LI Group Limited case involved an employee who had learning difficulties. The Tribunal ruled that the employee is considered disabled under the DDA basing its conclusion on the testimonial evidence of the employee’s parents and the fact that the employee was receiving disability living allowance (Walton v LI Group Limited, 1600562/97). The increased awareness for mental health and issues associated with it has accelerated in time, clinical depression is in fact already considered as a disability. Clinical depression is a ‘common mood disorder in psychology and psychiatry in which a person’s enjoyment of life and ability to function socially and in day-to-day matters is disrupted by intense sadness, melancholia, numbness or despair’ (Farlex Free Dictionary web site, n. d. ). In the recent appealed case of O’Hanlon v Commissioners for HM Revenue & Customs, the Employment Appeal Tribunal ruled that clinical depression is considered a disability and therefore falls within the coverage of the DDA 1995 [O’Hanlon v Commissioners for HM Revenue & Customs (2007) EWCA Civ 283]. Applying the above discussed legal principles to the given hypothetical case, Vangeer has been diagnosed to be suffering from clinical depression. This was brought about by the incident when she accidentally pricked herself with a needle which she picked up while cleaning a bus in the depot of her employer. This caused panic attacks and anxiety and for which she was given a year off from work. At this juncture, it is important to stress that the Health and Safety at Work etc Act 1974 requires the employers to ensure the health and safety of its employees in the place of work. Towards its realization, the law imposes upon the employer the duty to make ‘the provision and maintenance of plant and systems of work that are, so far as is reasonably practicable, safe and without risks to health’ (Section 2 (2)(a), HSWA 1974). This means that Snail Pace Bus Company should have provided a system of work including protective gear for those who clean their buses (Health Safety Executive, 2006). In addition, the employer is also supposed to take measures to protect their employee who may return to work considering that there is more likelihood that the employee may be weak because of the injury or disability (Health Safety Executive, 2006). Vangeer went on sickness absence for about a year. Sickness absence may be short term or long term. A long term sickness absence connotes serious medical reasons such as in the case of Vangeer. Long-term absence is ‘usually defined as a period of absence in excess of two weeks’ (Corcoran, 2006). When she returned for work, a new team leader made discriminatory remarks about her race. In hindsight, this may be considered as a violation of the Race Relations Act 1976. It may be shown that there is direct discrimination of Vangeer because she is black such as when she is treated less favourably than another (Thompsons Solicitors, n. d. ). Moreover, it may be shown that there is some form of harassment under the Race Relations Act 1976 as amended by the New Regulations of 2003 (Thompsons Solicitors, n. d. ). Harassment is broad as to include ‘abusive language, excessive monitoring of work, excessive criticism of someone’s work etc. ’ (Thompsons Solicitors, n. d. ). It may be claimed that Vangeer suffered by because she was degraded, intimidated and her dignity violated. The violation of her dignity is subjective and the Tribunal would need to rule using the ‘reasonableness’ standard (Thompsons Solicitors, n. d. In this case, the effect of Bob’s conduct has caused Vangeer to go on sickness absence for three weeks more based on the recommendation of her psychiatrist. Her transfer to another team was also suggested. Even before the period of sickness absence has lapsed, Snail Pace Bus Company was bought by Slow Coach Ltd. and Vangeer was called to a meeting about her absence. Thereafter, she was dismissed from her employment with pay. Her dismissal is illegal. ‘In relation to long-term sickness absence, the employer who dismisses an employee faces three potential legal risks’ (Lemon & Co. 2008). Vangeer may file for a claim for unfair dismissal, for disability discrimination and for violation of her contract of employment. It is axiomatic that there exists between the employer and the employee, a contract of employment. It is an agreement whereby the rights and obligations of both the employee and the employer are specified (Direct. Gov web site, 2008). When the employee accepts employment, there is an automatic contract of employment that is created regardless of whether this has been reduced into writing (Direct. Gov web site, 2008). Generally, employment contracts contain the following clauses: ‘commencement, term, job title and duties, place of work, hours of work, pay, holiday entitlement, pension, sickness absence, intellectual property, confidentiality, termination disciplinary, dismissal and grievance procedures, and collective agreements’(Clickdocs web site, n. d. ). The terms of employment in respect of hours of work, pay, termination of employment and other benefits are provided by the statutes. This being the case, the employer is mandated to comply with the provisions of the statutes. For instance, dismissal procedures should be observed. In the instant case, Vangeer was invited to a meeting to discuss her absence and after a day she was dismissed from employment with pay. The Employment Act 2002, Part 3, Section 30 (1) provides that, ‘Every contract of employment shall have effect to require the employer and employee to comply, in relation to any matter to which a statutory procedure applies, with the requirements of the procedure’ (EA 2002). The law requires that the employer observe the procedure in cases of dismissal as provided for under section 29, Schedule 2 Statutory Dispute Resolution Procedures, Chapter 1 and 2. Substantially, the employer is required by law to put into writing the circumstances and acts of the employee which he led him to initiate disciplinary or dismissal steps and invite him to discuss it in a meeting. The employee must have notice and reasonable opportunity to be apprised of the same. After the meeting, the employer must inform the employee of his decision and inform him of his right to appeal. Should the employee opt for an appeal, another meeting should be scheduled before the dismissal or the disciplinary penalty shall have been effective (Section 29, Schedule 2, Chapter 1, EA 2002). In the instant case, Vangeer apparently may have been given an unfairly short notice and was not informed of her right of appeal if she was not satisfied with the decision. In retrospect, the jurisdiction over wrongful dismissal cases were lodged in courts until 1994 when jurisdiction was given to the Employment Tribunals which were authorised to grant only up to GBP25,000 (British Employment web site, 2007). A contrary rule is observed with respect to unfair dismissals and discrimination cases, where the courts can award greater amounts of monetary damages. Wrongful dismissal results when employer fails to give the employee notice in accordance with the employment contract and without appropriate pay (British Employment web site, 2007). It has been observed though that it is better for the ‘employee to sue if the contract provides a fairly long notice period’ (British Employment web site, 2007). Monetary damages in these cases are computed based on the amount of loss in terms of compensation and other benefits. Unfair dismissal occurs when the employee is terminated from employment and the employer in doing so had no valid and justifiable reason (Direct. gov web site, 2008). The Employment Rights Act 1996, specifically Part X sections 111 to 132 provide for the remedies in case of unfair dismissal. In a nutshell, there are three options: an order for reinstatement, an order for re-engagement or an order for compensation. Reinstatement is when the Tribunal orders the employer to put the employee back to work with the same position and assigned tasks. There is re-engagement when the employee is placed back to work with a new post and tasks but under the same employer ((British Employment web site, 2007). In cases where the Tribunal issues an order for reinstatement or re-engagement, it cannot also order compensation [Wilson (HM Inspector of Taxes) v Clayton (2003) EWCA Civ 1657]. In the instant case, Vangeer was unlawfully dismissed because of her long absence. The Employment Rights Act 1996 provide for the employer’s responsibilities in case sickness absence and dismissal are due to ill-health (Mace & Jones web site, 2007). Bad health may be considered a good basis for dismissal of an employee because it affects the ability and capacity of the employee to perform his assigned duties and tasks. The law mandates that in order for a dismissal based on ill-health can be considered as fair, the employer must observe and comply with the legal requirements (Mace & Jones web site, 2007). The employee must be given the reasonable opportunity to recover and return to work before they can be dismissed’ (Lemon & Co. web site, 2008). In the instant case, Snail Pace Bus Company gave Vangeer about a year to recover from her clinical depression. A return to work programme was drawn up for her. Her relapse was instigated by her new manager. She was given a three week off from work and before the lapse of that time she was dismissed after the discussion with Slow Coach Ltd. Vangeer apparently was not given a reasonable opportunity to even use her three week off when in fact, the relapse was caused by management. However, it should be pointed out that not in all cases shall the employer be liable even if he partly or wholly was responsible for the incapacity of the employee. In the case of McAdie v Royal Bank of Scotland [2007] EWCA Civ 806, the Employment Appeal Tribunal reversed the decision of the Employment Tribunal when it ruled that the dismissal was justified even if the employer, partly or wholly caused the employee’s incapacity because based on the medical evidence obtained ‘there was no prospect of the employee returning to work’ [McAdie v Royal Bank of Scotland (2007) EWCA Civ 806]. Another requirement would be is for the employer to seek evidence of the medical status of the illness of the employee. The employer must request for medical reports from the employee’s physician upon the authorisation of the former (Lemon & Co. web site, 2008). The employer may also request for the examination of the employee by the employer’s own physician. The meeting should be for purposes of assessing the current medical state, the existing medical advice and medical evidence. In the case of Vangeer, Slow Coach Ltd. ailed to request the medical reports from her physician. Moreover, the employee must be consulted through a series of meetings for purposes of exploring ways and issues for alternative options and reasonable adjustments (Lemon & Co. web site, 2008). Albeit, there is one meeting conducted with Vangeer, no exhaustive discussion seemed to have been made. Finally, ‘The employer must consider the possibility of making adjustments to the working environment in order to permit the employee to return to work’ (Lemon & Co. eb site, 2008). When Vangeer was ill the first time, the employer made a programme which allowed her to start work late and go home early. However in the case of relapse, the suggestion that she be re-assigned to a different team was not deliberated upon and carried out by Slow Coach Ltd. It is the responsibility of the employer to seek and accept suggestions from the employee on how she can work when she returns. In a complaint for unfair dismissal, the Employment Tribunal shall take the following factors into consideration: ‘nature of the employee’s illness, the likely duration of the illness, the nature of the job, the needs of the employer, the employee’s length of service, the type (and amount) of sick pay paid to the employee and alternative employment’ (Lemon & Co. web site, 2008). The most important factor that will be considered is whether the employer took measures in gathering information and ascertaining medical reports from which he would base a fair and reasonable conclusion and decision. There must be recent, comprehensive and competent medical findings (Direct. gov web site, 2008). He must also comply with the procedures in dismissing an employee in accordance with the Employment Act 2002 and the Dispute Regulations 2004 (Direct. gov web site, 2008). Failure to follow the â€Å"statutory minimum dismissal and disciplinary procedure† shall make him liable to ‘a minimum basic award of 4 weeks pay. Furthermore, any compensation awarded by an Employment Tribunal may increase by 10-50%’ (Direct. gov web site, 2008). There is no distinction between sickness absence and disability. In the case of Clark v Novacold (18901661/97) ‘the Industrial Tribunal concluded that there should be no distinction between the two, and dismissal for sickness absence does in fact relate to the disability and accordingly is prima facie unlawful’ (Thompsons Solicitors web site, 1997). According to Solicitor Michael Corcoran, if the disability is the cause of the long term sickness absence and the employee was in fact dismissed, such dismissal is tantamount to discrimination unless it is shown that dismissal is justifiable (Corcoran, 2006). The lack of knowledge of Slow Coach Ltd. may have on the disability would be irrelevant and immaterial to the issue of whether Vangeer was treated less favourably (Corcoran, 2006). Under Section 20 of the Discrimination Disability Act 1995, direct discrimination is committed when the employee is ‘treated less favourably’ than another not suffering from such disability and that such treatment is by reason of the employee’s disability (DDA 2005). Moreover, the employer shall also be liable if he failed to make reasonable adjustments so that the disabled employee can continue his or her employment (HSE, n. d. ). The law requires that the employer ‘go an extra mile’ for the disabled employee, albeit the law does not set parameters of its extent. However, case law has laid down legal principles based on each of the precedent-setting case (HSE, n. d. ).
